II. Business Relationship

For the business relationship between MOMAX Pilates GmbH and the customer, only the following General Terms and Conditions in their version valid at the time of the service apply. The transfer of booked sessions by the customer to other customers is excluded.

III. Training and Training Agreements

A training session lasts 55 minutes. The length of individual private sessions may differ if a separate agreement has been made between MOMAX Pilates GmbH and the customer.

Training sessions take place in the premises of MOMAX Pilates GmbH.

Appointments are by prior arrangement only. Booked appointments can be cancelled only up to 12 hours (group classes) or 24 hours (personal training) before the start of the class. In case of later cancellation or no-show, the full session fee will be charged.

All bookings can only be cancelled via the app or website. Cancellation by email or phone is not possible.

IV. Right of Withdrawal

Consumers are entitled to the statutory right of withdrawal. Consumers may withdraw from the contract within fourteen days of its conclusion without giving reasons, provided that no class has been booked. To exercise the right of withdrawal, the consumer must inform MOMAX Pilates GmbH of their decision to withdraw by means of a clear statement (by letter or email).

The right of withdrawal expires for service contracts once the service has been fully provided. If services are provided by MOMAX Pilates GmbH before the withdrawal period expires, the customer must pay reasonable, proportional compensation for the services already provided.

V. Liability and Notices

MOMAX Pilates GmbH is generally not liable for damages suffered by a member or customer. This does not apply in cases of breach of essential contractual obligations, injury to life, body or health, or damages caused by intentional or grossly negligent conduct of MOMAX Pilates GmbH, its legal representatives or agents. Essential contractual obligations are those whose fulfillment enables proper execution of the contract and on whose compliance the customer may reasonably rely.

Any other liability beyond the cases mentioned above is expressly excluded.

Members and customers are explicitly advised not to bring valuables into the studios. MOMAX Pilates GmbH assumes no responsibility for safeguarding such items. Depositing money or valuables in lockers provided by MOMAX Pilates GmbH does not establish any duty of care regarding these items.

VI. Consent to Data Collection and Processing

MOMAX Pilates GmbH collects, processes and uses personal data only for the purpose of contract execution, customer service and its own marketing activities. This includes data provided during registration, such as name, address, phone number (mobile and landline), email address and bank details.

Data processing is carried out in accordance with the GDPR and applicable data protection laws, based on Art. 6 (1) a) and b) GDPR, and only for the purposes mentioned above. No further processing beyond the contractual purpose takes place. If additional data is required, separate consent will be obtained. For further details, reference is made to MOMAX Pilates GmbH’s privacy policy.

VII. Miscellaneous

No verbal agreements exist in addition to this contract. Any amendments must be made in writing, unless otherwise agreed. This also applies to changes to this written-form clause.

If any provision is invalid or unenforceable, the validity of the remaining provisions remains unaffected. The invalid provision shall be replaced by a legally permissible regulation that comes closest to the intended economic purpose.

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

The exclusive place of jurisdiction is Munich if the customer is a business or has no general place of jurisdiction in Germany. Otherwise, statutory provisions apply.
